Ehlers Attorneys possesses the professional knowledge, experience, personnel and infrastructure to render a quality service relating to any aspect of conveyancing and property law, which include:
- Drafting of sale of property agreements;
- Registration of transfer of residential, commercial and sectional title property;
- Registration and cancellation of mortgage bonds;
- Opening of sectional title registers;
- Property development;
- Establishment and registration of township developments;
- Registration of land consolidation and subdivision.

This is achieved by providing advice, explaining the procedures and costs of all transactions, keeping clients updated about such transactions, and providing a follow-up service. We are actively involved in the property market and our client base includes Estate Agents and property developers. The firm maintains a close working relationship with our clients and assists them with the identification and planning of projects and procurement of funding for such projects, as well as procurement of end user bonds for the purchasers of individual stands or units.
Procedure / Process:
- Once the purchase contract is signed, the Purchaser must apply for a Mortgage Bond or pay the balance of the purchase price in cash.
- Transfer Attorney receives the instruction and signed contract
- The contract usually requires the Purchaser to deliver a guarantee to make payment of the purchase price on registration.
- The Seller and Purchaser are contacted by the attorney and certain documents and information are requested.
- Cancellation figures are requested to cancel the bond of the Seller. The normal turn-around time of the banking institution is five days, but it can take longer. The same banking institution will then forward the original Title Deed and Mortgage Bond(s) to the Cancellation Attorneys.
- Rates and Taxes Clearance figures are requested from the Municipality. This usually takes five to ten working days.
- If a deposit needs to be paid, it will be called for by the Transfer Attorney. The Purchaser must always ask for a receipt as proof of payment.
- Once the Mortgage Bond has been granted and the aforementioned is in place, the Transferring Attorneys will schedule for the documentation to be signed and costs called for.
- Once payment has been received, Transfer Duty will be paid to the Receiver of Revenue (takes approx. 1 -3 working days to obtain the required Transfer Duty receipt);
- The local Municipality is paid to obtain Clearance Certificate (3 – 5 working days).
- Both the above documents are lodged at the Deeds Office.
- The Bond Attorneys will schedule a signing for the documentation only after receipt of the Draft Deed and guarantee requirements from the Transfer Attorneys. The Transfer Attorneys on the other hand, can only forward their guarantee requirements and Draft Deed once they have received the Cancellation Figures and a copy of the Title Deed from the Cancellation Attorney.
- The Transfer Attorneys arrange for simultaneous lodgement with the other attorneys.
- The Deeds Office takes approximately seven to fourteen working days to check all the documentation, where after the Transfer and Bond will register.
